Plant breeders who are employed under a labor contract or who work in public institutions have the right to claim financial remuneration from their employer for the varieties they have developed, pursuant to Article 12 of the Law on the Protection of Breeders’ Rights for New Plant Varieties. If this remuneration is not explicitly defined in the employment contract, the amount is determined by a court decision.
For breeders working in public institutions, the basis for remuneration is set forth in the Regulation on the Entitlement of Public Officials to Breeders’ Rights. For those employed in the private sector, the amount is calculated based on the economic value of the variety, using different methods recognized in practice.
