The importance of “branding” all over the world and in every field is undeniably understood today. Breeders remain behind the camera, not on the stage, in all processes until they reach the consumer. Although everything starts with the seed, unfortunately, the person who shapes the seed does not have a seal on the seed. The brand is this seal. Since branding requires a holistic strategy, it should be planned with a corporate management approach.

Initiation And Follow-Up Of The Trademark Registration Application

After the branding decision is made and the strategy is planned, it is necessary to initiate the trademark registration before the Turkish Patent and Trademark Office by deciding on the brand suitable for the market and to follow up until the registration is realised.

  • LICENSING OF THE TRADEMARK: In addition to the breeder’s licence rights on seed breeding, the trademark created by the breeder will also be used in the continuation of the seed processes or in other related products. It will be necessary to plan the granting of this authorisation of use through licence agreements and to prepare the contents of the agreements.
  • TAKING MEASURES TO PREVENT THE EXPIRY OF THE TRADE MARK: The registration of a trade mark alone does not keep it alive forever. The trademark owner should make renewals to make the trademark valid and should not cause a period of “non-use” that will cause cancellation.
  • COMBATING INFRINGEMENT: The growth and widespread use of trade marks also makes them vulnerable to malicious attacks. For this reason, methods such as filing infringement lawsuits for cease and desist, including compensation claims, filing complaints to the Prosecutor’s Office, taking necessary precautionary and seizure measures in the processes are used to combat infringements against trademarks.
  • PREVENTION OF REGISTRATION OF SIMILAR TRADE MARKS: In the event that third parties apply for the registration of the same or very similar trademark of an existing trademark, objections are filed before the Turkish Patent and Trademark Office in order to prevent these applications.
